Obama paints a bullseye on New York City

President Obama’s decision to put Khalid Sheikh Mohammed on trial in New York City along with four others accused of helping destroy the World Trade Center and attack the Pentagon on 9-11 paints a bulls-eye for terrorists right on New York City, their favorite target. Now Obama has identified where the terrorists should focus their energies – on New York City.

His decision to bow to political correctness and not to try Mohammed at a secure military base and to try him in a civilian court, according him all the rights of an American citizen, raises important questions:

Most importantly, is the admissible evidence against Mohammed damning enough to secure a conviction? The evidentiary requirements protecting an American citizen on trial are far stricter than those which would apply to an enemy combatant before a military tribunal. We already watched how the twentieth hijacker, Zacarias Moussaoui escaped the death penalty because the evidence the government could use against him in a civilian criminal court was limited by his civil liberties. As a result, the data from his computer, which had not been seized pursuant to the Fourth Amendment, could not be entered into evidence against him. Failing such evidence, the feds had to settle for a life sentence.

Since much of the evidence against Mohammed was gathered through interrogations before which he may not have been read his Miranda rights and during which he may have been water-boarded, one wonders how much of his statement that he was the mastermind of 9-11 is going to be admissible. It could be that he will use the very constitution of the very government he seeks to destroy to protect himself from the death penalty or even life in prison.

The decision to try him in a civilian court also confronts the Department of Justice with a difficult decision on how much of the evidence against Mohammed should be aired publicly. Our anti-terror investigations depend on secrecy and the FBI and Homeland Security agents may not relish having their methods publicized in open court. There is even the possibility that there will be a global backlash in favor of Mohammed as his defense lawyer – paid for by the American taxpayer – will make him appear to be the victim of over-zealous investigators and prosecutors rather than the perpetrator of one of the greatest mass murders in history.

In any event, President Obama is affording the terrorists exactly what they wanted in the first place – a global stage right near New York’s theater district. The very goal of terrorism is to attract world-wide attention and, by trying Mohammed in a civilian court in the middle of New York City, President Obama is giving them the stage they want on which to articulate their perceived grievances.

Finally, there is the disturbing question of what will happen if Mohammed and/or his some of his confreres are found to be not guilty. Where will they be released? Will they walk out of the courtroom free to prowl the streets of New York, their transportation having been paid courtesy of the taxpayers? Will they be flown to Afghanistan to resume their plots against our government and our people, again at taxpayer expense?

What Obama should have done was to try Mohammed before a military tribunal, without the full rights of an American citizen (which, of course, he is not) and, after a guilty verdict, executed him.

    What Obama should have done was to try Mohammed before a military tribunal, without the full rights of an American citizen (which, of course, he is not) and, after a guilty verdict, executed him.

    But that was his signature issue; granting full fights to enemy combatants is more important than anything else on the agenda.

    I was reading one commentator, forget who, but they pointed out that when these terrorist were brought into custody a civilian trail is not what was expected by the military and because of that, the evidence against the terrorist hasn’t been properly prepared.

KSM, a confessed jihadi engaged in acts of WAR against America will get a nice leisurely trial in civilian fed. court during which so much sensitive material will be revealed to the enemy abt. how we try to remain safe in this country. Our safety will be compromised because of Zero. This is a disaster waiting to happen.

    35 years ago I sat shotgun in a friends car as we went into a turn at way too fast a speed. I watched helplessly as he did everything wrong to correct the spin we were in. We crashed through the guard rail and went airborne. I’ll never forget that sensation of traveling in slow motion through it all and having the time to think “This jerk is gettin’ me killed and there ain’t a damn thing I can do about it”. Obviously, despite what I thought at that moment, I did live through it. But,for the past 35 years,I’ve insisted on doing the driving where ever I go and no matter who I’m with.Strange,I don’t know what could have caused this memory to resurface just now…

    For the record I think KSM should be tried and convicted in a mil. tribunal and tied to 2 C130s going in opposite directions.
    The decision to try him in NYC is typical ‘symbolic’ progressive bullshit.
    The security will be (should be) so tight that terrorism concerns may be offset by drawing some bad guys onto intelligence radar.

    That being said, and not being a lawyer, maybe some legal eagle can help me out here.

    How can Holder hope to get a conviction in a civilian court when
    the “suspect” was:
    1. captured in Pakistan by Pakistani ISI
    2. turned over to US intelligence, not law enforcement
    3. Gov’t acknowledges waterboarding him
    4. held a an undisclosed location before being sent to Gitmo
    5. held for years at Gitmo
    6. not charged until sent to NY

    Sounds more like Holder is tied to the C130s.

    The trial will be totally unfair. KSM and the other scumbag terrorists should be judged by a jury of their peers. That might be kind of hard to achieve in New York and they surrounding area, considering that’s where the main attacks took place.

    I suggest that the trail gets moved to Berkeley, California or some other liberal city. That’s where their peers are. I wouldn’t even mind if the terrorists get released due to some technicality and they are left to their own devices in that liberal city.

    That unnamed blog was also dead wrong when it came to Bush bowing. Bush never did bow to the Saudi king, he was bending to get a medal placed around his neck. That is not a bow. Obama did bow, both to the Saudis and to the Japanese.

    I was thinking the same thing. This is a fucked up sneaky way to put the US and Bush on trial. THe POTUS duty is to protect the constitution. How is an act of war by foreigner’s considered a civil matter? How do they twist the logic that foreign enemies are entitled to American Constitutional rights? What then is the point of the Constitution? It will be totally meaningless. We have the right to overthrow enemies both foreign and domestic. The constitution did not give rights of any kind to enemies.

    It is clear that our government has turned against the people. Each day they throw massive curve-balls at us.

    Bail outs, the stimulus, controlling health care insurance, signing the global carbon treaty next month, giving rights to the enemy. Is anyone in any sort of power going to put an end to this? They don’e care what we demand to put an end to. They do as they please. As it is, a foreign enemy managed to make it to the top of our government.

    I watched several different groups of talking heads discuss this yesterday and what keeps getting lost in all this is that KSM and everyone else at Gitmo are “Unlawful Combatants” and that is a particular legal status which makes them not common criminals and not POW’s.

    In that status, which is due to having been captured armed in a war zone while not part of any recognised army, leaves them with no process rights whatsoever. It elevates their status to insist that they are “entitled” to civilian legal process. Worst of all, this status exists precisely to protect civilians in war zones from the depredations of terrorists. Elevating the status of the terrorist diminishes and endangers civilians.

    All apart from the political consequences of giving these war criminals a civilian trial, it is an abomination against all recognised rules of civilised warfare. Just holding these trials shreds the Geneva POW Convention.

    The differences between me and Obama, however, are huge. My American father was emphatically not an anti-American, neo-Marxist twit. And my Bolivian mother was always pro-American. (She is now a US resident & citizen and a huge patriot, who despises Obama and all he stands for.)

    People deal with cultural alienation in different ways. Hatred is one way to deal with it, and I believe it is the way Obama chose.

    In Dreams from My Father he tells us that he dumped his white girlfriend because he had come to believe that, in order to be authentically black, he had to hate whites. Enough said. He chose to create an identity based on racism and radical opposition to mainstream America….an America he never even bothered to get to know.

    Outside of making him a POS, did it work? I don’t think so. The fake accent he uses when addressing American blacks tells me he doesn’t really feel at home with them either.

    The man is a headcase.
