I woukld like to dedicate this Post to our beloved M. She has been a good freind to me in the year I have known her. Today is her Birthday and I would like to wish her a happy Birthday and may she have many more!

    Did Holder stiff Senate on Justice Dept. lawyers who defended jihadis?

    It seemed a reasonable request, but Holder appeared decidedly cool to the idea. “Yes, I will certainly consider that request,” he said. “But I want to make sure that you understand that the people in the department understand their ethical obligations. And to the extent that recusals are appropriate on the basis of prior representations or prior connections, people in the department have recused themselves from specific cases.”

    “But I asked you for information,” Grassley responded. “Will you provide it?”

    “I will consider that request,” Holder repeated, adding that the lawyers involved are “fine public servants” and “patriots” who have “national security uppermost in their minds.”

    In other words, “go away, Senator, you bother me”.

    This is something I’ve wondered about:

    Ashcroft: Holder lacks legal authority to order terror trials

    Attorney General Eric Holder lacks authority to make a decision on moving terror detainees to civilian courts for trial, one of his predecessors said Wednesday.

    Former Attorney General John Ashcroft, who held his position during the Bush administration from 2001-2005, said that Holder lacked the legal standing to decide to move alleged 9/11 mastermind Khalid Shaikh Mohammed and other terror detainees to federal courts in New York City to stand trial.

    “The attorney general doesn’t have the authority to mandate that the secretary of Defense turn somebody over to him and yield jurisdiction so that something that would have been done in a military setting is done in a civilian setting,” Ashcroft told the Christ Stigall show on KCMO radio this morning.

    I raised the question yesterday as to whether this amounted to a directed order of acquittal, but that was only because I couldn’t see the AG having the legal standing to do anything else. Otherwise, prosecutors would just go jury shopping, stopping the trial everytime it didn’t look like it was going so well, until they found the I>one time to convict, and then that is the only real trial. kind of like the way Democrat view elections.

Whether or not Obama directly ordered this, it is his and he should own it. And it is a terrible failure of leadership, and may have catestrophic consequences, especially if my worst fears become reallized.

    Didn’t Holder state in his testimoney that he had NOT talked to Obama about his decision? Didn’t Obama say the call had been all Holder’s?
    Not that anyone with an IQ over single digits believes that crap…….

    I’ve not heard Holder’s testimony, but if that is the case then it brings back Ashcroft’s assertion that the AG lacks the authority to do something like this. That would be my speculation as well, but thtat is only speculation. It seems to invite all kinds of prosecutorial misconduct if the AG can just step in without any fanfare and quash one prosecution, and change veneus to another.

    Obama really thinks we are complete idiots. If it really were true that the call was all Holder’s, which none of us believes, I could hardly think of a greater dereliction on the part of a POTUS. Does he think that this is a trivial matter that can be left to the whim of a subordinate? Would he rather have people think he’s negligent than take responsibility for this decision?

    That spoiled brat is still trying to vote “present.”

    I’m not doubting you, but do you have a link? I’ve not seen anything but speculation, but I haven’t been able to follow the case as closely as I might like. Even a President has to tread lightly when he is using his powers against the Judiciary. The military is technically his to command, but we all know there are some orders that should not be given, and if given, should not be obeyed.

    If Obama did this openly, then the Republicans should rape him with it. Sure the orders had to come from him. There’s no way an AG, any AG, would have done this on his/her own.

    But Holder may be left holding the bag to gove cover to his boss. There will be political consequences for this. look how it split LGF even after all the efforts to crush out independant thought. Only the truly hard Left like this move, and they are a small minority og the electorate. A move like this could guarantee Obama is a one-termer. Of course, such a move could also indicate that he has accepted that he is a one-termer and that he’s going to do as much damage “good” as possible in that term.

    Last night, just hours after he took the oath of office, Obama ordered Secretary of Defense Robert Gates to direct the chief prosecutor of the Office of Military Commissions to seek a continuance of 120 days for any case that has been referred to the office of military commissions and to cease referring any new cases for prosecution.

    This morning, military judges hearing the cases of Khalid Sheik Mohammed, the self-confessed mastermind of 9/11, and his co-conspirators, as well as a different judge hearing the case of Canadian detainee Omar Khadr, granted the prosecution’s motion.

    According to the motion filed by the prosecutors, the continuance was requested “in order to provide the administration sufficient time to conduct a review of detainees currently held at Guantanamo Bay, Cuba, to evaluate the cases of detainees not approved for release or transfer to determine whether prosecution may be warranted for any offenses those detainees may have committed, and to determine which forum best suits any future prosecution.”

    Which brings up yet another issue. No matter which way the judge rules on Miranda and a number of other issues, this is headed for the Supreme Court. Period. When you deviate this much from past practice, a visit to the SCOTUS is inevitable.

    This’ll still be going on in 2012. But it’s just about impossible for this to not hurt the donx, no matter what else happens.
