Contempt of Court

Anyone who has ever had any dealings in a court of law knows well what the phrase “contempt of court” means. That means that if you’re insufficiently respectful of the court and the judge, you can go to jail.

Anyone who listened to the SOTU speech last night heard a most amazing and unprecedented thing – brazen and open contempt of the SCOTUS to the faces of six of the nine by the POTUS. Ordinarily, this would be considered gauche, but let’s remember one thing. That this POTUS was once a professor of Constitutional Law. Thus, as much as a gaffe like this would be inexcusable coming from a Ronald Reagan or a George Bush, it should be a lot more inexplicable coming from Professor Obama.

But it’s even stranger. On this point of the McCain-Feingold decision, the POTUS said:

Last week, the Supreme Court reversed a century of law to open the floodgates for special interests — including foreign corporations — to spend without limit in our elections,” Obama said. “Well I don’t think American elections should be bankrolled by America’s most powerful interests, or worse, by foreign entities. They should be decided by the American people, and that’s why I’m urging Democrats and Republicans to pass a bill that helps to right this wrong.

I’m not a lawyer (and I won’t say where I’ve stayed), but it’s pretty obvious on inspection that there’s a elephant-in-the-parlor type problem here. It’s a matter of basic civics that if something is ruled unconstitutional in the US, that’s the end of the discussion barring a constitutional amendment.

Note that he didn’t say pass a constitutional amendment. He said “pass a bill”. The professor of constitutional law said, outright, that congress pass a bill to correct a SCOTUS ruling.

Now it might in theory be possible in some situations to correct a technical flaw in a bill to avoid a constitutional issue, if the constitutional issue is peripheral to the thrust of the bill. This is clearly not the case with MF. The SCOTUS said that the main thrust of the bill was unconstitutional.  And the constitutional law professor wants to work with congress to undo the SCOTUS ruling. I’m just astonished. So was Justice Alito.

POLITICO’s Kasie Hunt, who’s in the House chamber, reports that Justice Samuel Alito mouthed the words “not true” when President Barack Obama criticized the Supreme Court’s campaign finance decision.

The shot of the black-robed Supreme Court justices, stone-faced, was priceless.

The court was not prepared for this in-your-face Chicago-style contempt. This is what hopenchange looks like when it doesn’t get its way. It gets pissy and childish. And contemptuous. But as they said in the ’70s, here comes the judge.

    Allegedly, he was offered a tenure-track position, but he turned it down so as not to deny his talents to the nation at large.

    I read the case. Sounds like BHO did not. It does not say this at all. The disclosure requirements have been upheld and the decision never reached the issue of foreign donations.

    Boggles the mind that the libs refuse to see this a free-speech victory.

    What the Court did is what the Court does they interpret the law according to their own personal biases, hopefully actually following the Constitution.

    Interesting though is that this only bothers a New Leftist when the decision is against their liking.

    Funny how they accuse, in different words, the Court as being activist when they vote against their policies, but embrace completely a horribly legally incorrect decision such as “Roe v Wade”.

    As the left likes to say “Slavery was long held law too…”

    Given the way Obama’s donation website had the basic software for receiving online donations altered so that repeated donations which might be over the limit, and foreign donations which are not allowed, could be received and processed without triggering the appropriate responses, his sounding the alarm about foreign donations—even if it were true—is the very nadir of hypocrisy.

    I am a lawyer. First, Zero got it flat out wrong. Foreign corps cannot make contributions. Second, Zero took an oath to uphold the Constitution. Members of Congress do the same. Thus, they have a duty to refuse to enact unconstitutional laws. It’s not that hard to figure out. Third, the Supreme Court was there out of respect and Zero was petty and small in comparison. Just wait until the Supremes have an opportunity to respond.

    Considering the fact that Obama likely took in about $250 million in illegal foreign contributions to his own campaign, he has a lot of nerve raising the issue of foreign money in politics.

    On another note, I see the left is upset because he only promised to “work with Congress” to end the “don’t ask, don’t tell” policy, instead of just issuing some sort of royal decree or something.

As for Savage, he has had his opportunity to speak his mind (he was on the thread a bit ago), and has stated that it is his desire to compose a thread using personal e-mails.     If that is the case, then the “work with Congress” line is a way of dodging his own responsibility and the consequences of his actions.

    Possibly. Those more familiar with the military than I can speak to that.

    I’m merely observing that his feints towards ending DADT were no more convincing than his strangled endorsement of building nuclear plants, domestic drilling, etc.; he was trying to placate an angry constituency while leaving himself wiggle room for selling out on what he had promised them.

    Well, I don’t think the posts can be altered back in the way you’re suggesting. I think they were altered because Wrath is no longer an admin.

    He should definitely get credit for his work, so perhaps they can be given his name in another way or something. There’s no way to put his name on them if he isn’t at least a contributor (if not an admin).

    This is something the admins can work out.

    I don’t think the whole year’s worth of interactions should become a topic. It would be simple enough to give Wrath credit without returning him to admin status (if this is part of the resolution).

    Anyway, I’m closing up about all this now, too.

    I’ll work on the term paper post from Wrath’s notes.

    His notes on all this are excellent, by the way.

    My guess is that he has been eating it most of his life. The paternalistic crap dished by the liberal elite is galling on its face. I’ve seen the soft bigotry of low expectations played out numerous times in my life. I always wondered what those on the receiving end thought about it but was always afraid to ask.

    at the same time he has say Dick Cheney on with them,,,,

    then they both live on TV tells them how they feels about Roe V Wade.

    How would Chris Mathews and the NYT view that?
