Obamacare Ruling Open Thread; Update: Mandate Upheld as Tax thanks to John Roberts

This is it people. Today’s ruling will determine our future. At 10:00 AM EST, the Supreme Court will rule if Obamacare is Constitutional. This is a ruling that will effect life or death for us. Obamacare is a step towards government control over people’s lives. A government panel will determine who can live or die. This opens up the door to eugenics and the Progressive dream of the perfect man.

Keep your fingers crossed people. I will update the thread when the ruling comes down.

Update: The mandate is upheld as a Tax. Thanks to Bush appointee John Roberts.

If anyone thinks that Liberal Republicans like Mitt Romney, John Boehner and Mitch McConnell will repeal this, you are dreaming. The Progressives have won. We need a Real Center-Right Party in America.

    Pray that this turd of a law is struck down in it’s entirety today- for the good of our nation. This back-door socialist bill aims to take over a major sector of the economy, and if it succeeds, then which industry is next? The goal is to have everyone dependent on the government, and voting reliably as Democrats every election cycle.

    This is interesting. Intrade is a site where you can trade shares (essentially bet) on just about any issue. This morning the index is showing a 70% chance that the mandate will be tossed. This morning I’ve seen a high of 76 and a low of 62.

    I’m not sure of the House schedule but SCOTUS is due to release their ruling sometime after 1000 Eastern. I suppose that means they could leave us hanging all day. Kinda like the cable guy. “We’ll be there promptly between 8AM and 5PM”. At any rate, 10AM sounds a bit early for getting anything done in Congress.

    Also, the opinion notes that states can’t have Medicaid funding pulled if they choose not to take part in the plan. I view that as the states now have an easier time of refusing to take part in Obamacare.
    If all the states don’t take part, it’s dead.

    I think all of us wanted to see him rebuked Constitutionally, given the fact he has essentially taken a shit on it multiple times since he has been in office.

    Not sure what all of this means just yet, but one can always hope there might be an end game around this we do not see yet.

    That’s the way it seems to me. They’ve technically upheld it, but the states don’t seem obligated to participate and -- more than half of the states joined in the suit in the first place.

    This is actually exactly what happened with Social Security, 75 or so years ago. FDR sold it to the public as a “retirement account,” and when it was challenged in court, he said it was a tax. That argument worked back then, and it worked today.

    Obama specifically said it wasn’t a tax. The Supreme Court says it is a tax.

How can you change the nature and meaning of a law after it’s passed?

    The language making the penalty for not having insurance a tax penalty paid to the IRS is in the bill. They wrote it that way on purpose.

    Contrary to what people have said, the Medicaid expansion wasn’t overturned. What was overturned was the threat to withhold 100% of a state’s Medicaid funds if they didn’t go along. They can still withhold the portion allocated to pay for the expansion itself.

    I pray that this happens! Not really sure exactly striking doing the mandate but upholding it up as tax means…but it doesn’t sound like what we wanted and from your post it does seem like there may be some hope to ending this disaster. I honestly don’t understand how they came to this conclusion.
    Thank God my son is getting his eyes corrected NOW…because I KNOW obamacare would deem him unworthy of any help other than take a pill.

    Laurence Tribe, a Harvard Law professor, predicted today that the Supreme Court will uphold Obamacare on Thursday with a majority vote led by Chief Justice John Roberts.

    “I do think the court will surprise a lot of people when it probably upholds the Affordable Care Act in an opinion written by another former student of mine, Chief Justice Roberts this Thursday,” Tribe said on MSNBC.”You can be deeply conservative and still believe that the Affordable Care Act is completely consistent with the United States Constitution.”

    He said that upholding the law would “be a partial antidote” to the argument — promoted by Obama and other Democrats, especially after the Obamacare oral arguments in March — that the Supreme Court has been politicized. Tribe argued on behalf of Al Gore in the Bush vs. Gore (2000) case pertaining to the Florida recount.

    Tribe played a role in a controversy surrounding Justice Elena Kagan, who ignored calls that she recuse herself from the case, even though she Kagan and Tribe exchanged emails hailing the passage of the bill in 2010.

    The mandate wasn’t struck down, it was upheld.

    The government made two separate arguments as to why they thought it was within their power to impose. One was the Commerce Clause, and the other was as a tax. The Court shot down the Commerce Clause argument, but went along with the tax one.

    This decision doesn’t set any new precedent. Congress has always had that power (or at least they have since the ratification of the 16th Amendment, which let them tax individuals).

    They just haven’t used it that much. It’s exactly how Social Security was allowed to stand, though, so it’s not a new idea.

    Now, if they’d accepted the Commerce Clause argument, then that would have been an awful decision.

    Several commentaries have pointed out that this is a huge tax increase as if that is a winning argument against Obama. It is not. Obama has been openly calling for tax increases all over the place, including such obscure areas as a mileage tax on vehicles, certain foods, energy, etc. In other words, ‘breathing’ taxes. He has written off any votes from the white middle class and has calculated that welfare recipients, the aged, single women, Latinos, gays, blacks, and most importantly, government employees will put him in office. Those groups love to see middle America punished by whatever means.

    Stock market reacting rather poorly. Ignored by MSM. Jobs figures tomorrow. Expect more adjustments in the way unemployed are calculated and the jobs created to be underwhelming. Jobs created may go into the negative by July as small businesses decide to close down, especially small manufacturing plants such as nickel plating etc. Better to take what you can now before employee costs, taxes and the EPA bankrupt small manufacturers. The calculation is this will re-elect Obama.

    The Chief Justice is essentially the head of the Judicial branch of the government. If he changed his vote as a result of external pressure, it was in an attempt to protect the institution of the court system from further attack by the left.

    And yep, I think Scalia purposefully left those mentions regarding Ginsburg in what was now the dissent because he wanted to let the country know what happened -- I don’t see someone like him missing those details.
