The apparent originator of the idea, Mr. Gebert, is talking about “trademark infringement.” If he filed an intent-to-use application for a trademark for his show, if that application was approved and is still valid, AND if O’Donnell’s proposed name/title is so close to Gebert’s as to be infringing, then Gebert might have some redress. But all that means is O’Donnell would have to change the title of her show; trademarks protect the proof of origin, not the idea.

So O’Donnell and Gebert both do their own shows—so what? There’s more than one “Pawn Stars”-type show on TV, there’s more than one decorating show, there’s more than one cooking show or house-hunting show. There’s even more than one liberal and more than one conservative political pundit show.
